Wedding Photography Contract, Terms and Conditions.
It is mutually agreed that the following terms of agreement, form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both the Photographer and the Client, in writing.
Upon your signature, the Photographer will reserve the time and date agreed upon and will not make other reservations for that time and date. For this reason, the Reservation Deposit is non-refundable, even if the date is changed or wedding cancelled for any reason. The Reservation Deposit of 20% is to be paid at the time of signing the contract. The Reservation Deposit is applied towards the contracted Wedding Package. Client understands and agrees that the entire amount owed for the Wedding Package described in the contract is due two weeks before the Wedding Day.
The Client will be responsible for identifying, or have someone designated to identify, people of whom specific photographs are desired. The Photographer will not be held accountable for not photographing desired guests if there is no one to assist in identifying and gathering people for photographs. The Photographer is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not being revealed to the Photographer or those beyond the Photographer’s control.
Venue and Location Limitations
The Client agrees and understands that the Photographer is limited by the guidelines of the ceremony official or reception site/venue management and agrees to accept the results that may occur from said guidelines. Negotiation with the officials for moderation of guidelines is solely the Client’s responsibility.
Limit of Liability
In the unlikely event that the Photographer is injured, becomes too ill, or has an emergency that prevents them from photographing the event, the Photographer will make every effort to secure a replacement photographer. If a suitable replacement is not found, the Client agrees that responsibility and liability of the Photographer to the Client is limited to the return of all payments received for the event. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the Photographer’s control, including but not limited to camera, hard drive, or equipment malfunction, the Photographer’s liability is limited to the return of all payments received for the Wedding Package. Once the client has received their wedding photographs in digital format, it is the client’s responsibility to keep copies and back-ups of the files. The photographer cannot be held liable for the replacement of the digital files should the clients USB become lost, stolen, or corrupt.
Photographs will be provided to the Client on a USB stick no more than twenty-eight (28) days after the Wedding Day. The Client agrees that this time scale does not apply if the outstanding balance has not been paid. No photographs, digital or prints, will be delivered until the Outstanding Balance is paid in full.
Digital Negatives, Prints and Copyright
The photographs produced by the Photographer, are protected by International Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos produced. The Client will receive a copy of the digital photographs on a USB as part of the Wedding Package. The Client may reproduce any images in any manner they like for sharing and enjoyment of friends and relatives. However, the Client must not reproduce any images for publishing or selling for profit.
All travel expenses are based on the distance between the event location(s) and the business address.For all events, the first 40 miles roundtrip of travel is included. All miles in excess of 40 miles roundtrip are charged at 50p per mile.
